David Eby Can’t Win as First Nations Say No Take Backs on DRIPA British Columbia Premier David Eby is facing serious backlash after a leaked meeting with First Nations leaders over a law called the Declaration on the Rights of Indigenous Peoples Act (DRIPA). DRIPA is a law meant to make sure Indigenous rights are respected in all B.C. laws, based on the global standard known as the United Nations Declaration on the Rights of Indigenous Peoples. A recent court ruling (the Gitxaala Nation v British Columbia case) said this law might already apply to all provincial laws right now. That created a big problem for the government. Eby says this could cause “legal chaos” because it would force the province to immediately change or review a huge number of laws all at once — something they say they’re not ready to handle. So his solution is to pause key parts of DRIPA for up to 3 years while the case goes to the Supreme Court. But First Nations leaders are furious. In the leaked meeting, they accused him of calling it “absolute betrayal”, damaging trust and relationships, comparing the move to colonialism, and making them feel like their rights are being slowly taken away again Some leaders said they felt shut out, disrespected, and blindsided, especially after being told the decision was “non negotiable.” Eby argues this pause is the “least harmful” option to avoid legal uncertainty. But many Indigenous leaders see it very differently. They believe it weakens protections that were supposed to be guaranteed. Today a land management plan will be enacted that will allow the spraying of #glyphosate – a toxic, carcinogenic chemical – broadly across the unceded territory of Stó:lō, St’át’imc, Nlaka’pamux, Musqueam, Squamish, and Tsleil-Waututh. This is where food and medicines are harvested . The plan will allow BC Timber Sales to spray #glyphosate for 5 years. These poisons will be used to kill berries, salal, mushrooms, hellebore, and other plants. Angelina Hopkins Rose, from St’át’imc First Nation, has been calling for gov't to pause the plan - arguing they were not consulted and asking for a 60-day extension, at a minimum, before spraying begins, so that they may raise their concerns with gov't. On Wednesday we celebrated the tabling of the #DRIPA Action Plan. We've repeatedly committed to repairing the legacies of colonialism. To upholding Indigenous rights, including their rights to territories, rights to fish, hunt, & gather medicines & foods, unencumbered. Yesterday Adam Olsen asked Katrine Conroy if in keeping with our commitments under the Declaration Act, she'll pause the spraying of #glyphosate set to begin tomorrow in order to consult with the Indigenous people affected? The answer was no. The Minister went as far as to say that glyphosate is not carcinogenic - a shocking response. He then asked if this gov’t believes that the rights of Indigenous peoples to harvest traditional plants are outweighed by the Ministry’s interests to maximize harvest volumes via the spraying of #glyphosate?
