Who gets to decide WHO YOU ARE? YOU, or THE GOVERNMENT? Under the previous Transgender Persons (Protection of Rights) Act, transgender people had the right to self-identify their gender —meaning you were the authority over your own identity. The proposed amendment in March 2026 removes self-perceived gender identity and introduces a state-appointed medical board, with the District Magistrate deciding whether someone can be legally recognized as transgender. This goes against the Supreme Court’s NALSA judgement and could erase a large part of the trans community including trans men and non-binary people, denying their legal recognition. It could also violate constitutional rights like protection from discrimination, freedom of expression and identity, and right to life.
