RE“Bitter Sweet Symphony,” one of the most iconic songs of the late 20th century, has a complex history marked by legal battles and poignant reflections on life’s struggles. The song’s signature orchestral riff originates from a six-second sample taken from an instrumental version of the 1965 Rolling Stones song “The Last Time,” as performed by the Andrew Oldham Orchestra for the 1966 album “The Rolling Stones Songbook.”
The Verve, poised to release their album “Urban Hymns” with “Bitter Sweet Symphony” as the flagship single, secured permission for the six-second sample from Decca Records, which owned the Oldham recording. However, an oversight emerged: they also needed clearance from the publisher of “The Last Time,” a realization that came after the album’s completion.
With the album ready for release, Verve manager Jazz Summers embarked on a quest to secure the rights, which were held by Allen Klein’s company ABKCO. Klein, the formidable manager who had acquired publishing rights to the Rolling Stones’ songs through 1969 due to a lopsided early contract, proved to be a formidable obstacle. Summers initially offered Klein 15% of the publishing rights, but Klein flatly refused. Recognizing the hit potential of “Bitter Sweet Symphony,” Klein insisted on 100% of the publishing rights.
Faced with the dilemma of being unable to release their hit record, the Verve reluctantly capitulated, succumbing to Klein’s demands. Richard Ashcroft, the lyricist behind the song, received a mere flat fee of $1,000 and was compelled to sign away his rights under duress. In Ashcroft’s own words, he felt coerced into surrendering what he considered “one of the greatest songs of all time.”
The consequence of this legal entanglement was Allen Klein profiting significantly from “Bitter Sweet Symphony” every time it was purchased or used in various media, showcasing the harsh reality of the music industry’s intricate legal landscape. Despite the challenges, the song endured as a poignant commentary on life’s struggles, etching its place in musical history despite the bitter battles that surrounded its creation.
