In the case of Union of India vs. Brij Systems Ltd., the Supreme Court has taken a measured approach 🧑⚖️.
👉 Brij Systems made a bona fide clerical mistake in GSTR-1 (FY 2017-18), leading to excess ITC.
👉 The rectification was denied by the department due to expiry of timelines under Sections 37(3) and 39(9) of the CGST Act.
👉 High Court allowed rectification ✅
👉 Revenue challenged it in SC 🚨
🎯 SC Observed: ✔️ Revenue accepted it was a clerical mistake
✔️ Such mistakes often come to light only when ITC is denied to the buyer
✔️ This issue needs deeper legal scrutiny 🔍
📌 As a result, SC: 🔹 Did not dismiss the case outright

Let’s break it down.
The Legal Loophole That Saved Zepto
The Zepto brand is owned by Kiranakart Private Limited, the company founded by Aadit Palicha and Kaivalya Vohra. They hold trademark registrations for Zepto in multiple categories—but not in Class 35 (which covers retail and business services).
Why? Because when they applied for a trademark in Class 35, they discovered that someone else had already registered the name ‘Zepto’—back in 2014!
How Did Zepto Get the Rights Back?
Here’s the twist: Zepto didn’t fight for the trademark. The original owner lost it himself due to a legal mistake—non-use of the trademark.
Under Section 47 of the Trademarks Act, if a registered trademark isn’t used for five years or more, any aggrieved party can file a rectification petition to cancel it. That’s exactly what Kiranakart did. They proved the previous owner wasn’t using the Zepto mark—and got it cancelled.

NAThe candidates of Group-II Mains examination scheduled to be conducted by Andhra Pradesh Public Service Commission (APPSC) on February 23, are in the grip of anxiety and uncertainty over the roster issue.
Citing errors in the roster system of notification issued on December 11, 2023, the candidates express concern that the recruitment process might face legal hurdles or even result in cancellation, similar to what happened in Jharkhand.
The Group-II job aspirants have been staging protests across the State, with a plea that the APPSC rectify the roster system before conducting the examination.
“Many aspirants are worried that if the roster-related issues are not rectified it could impact the fairness of the selection process and would affect their job prospects,” says S. Hemanth Kumar, president of Andhra Pradesh Unemployed JAC.

1 Unit of 43,000 sq. ft. LePaPa Hypermarket
During the thorough inspection, minor comments were raised by various MDB sections. In response, rectification works have commenced immediately.

CA🌟 New Functionality Alert: Application for Rectification Now Enabled! 🌟
As per Notification No. 22/2024-CT dated 08.10.2024 taxpayers can now file an application for rectification** of demand orders issued under **Sections 73/74 of CGST Act** for wrongly availed ITC.
Who is Eligible?
✔️ Registered persons who received demand orders confirming ITC wrongfully availed due to contraventions of **Section 16(4)**.
✔️ ITC that is now eligible as per the newly inserted **Sections 16(5) and 16(6)**.
**How to Apply?**
1️⃣ Log in to the GST Portal.
2️⃣ Navigate to **Services > User Services > My Applications**.
3️⃣ Select **”Application for rectification of order”** in the Application Type field.
4️⃣ Click on the **NEW APPLICATION** button.
5️⃣ Fill in the required details and upload the proforma in **Annexure A**, available on the Portal in Word format.
