Nearly half of all EEOC cases filed in 2024 were disability discrimination claims. That’s because too many employers are still mishandling disability accommodation requests.   Here’s what’s happening: An employee asks for a medical accommodation, and instead of working with the employee to find a solution, employers too often default to saying “no.” Other times, they demand private medical information that they are not entitled to.   The Americans with Disabilities Act requires employers with 15+ employees to provide reasonable accommodations unless it creates an undue hardship – a very high legal bar. Today we're celebrating 35 years since the Americans with Disabilities Act (ADA) was signed into law, a powerful step toward ensuring that people with disabilities have the same rights and opportunities as everyone else. The ADA mandates accessibility in public spaces, transportation, workplaces, and communication, and for that, I’m truly grateful. But even after all these years, many public places remain inaccessible, and equal job opportunities are still not guaranteed. That’s why I continue to raise disability awareness—to push for the changes we still need. Earlier this year, I reported a restaurant that wasn’t ADA compliant—because it’s better to speak up than stay silent. We deserve accessibility, dignity, and inclusion. Yes, I can and did ask for help. But that’s not the point. This is what an accessible hotel room looks like. While this room is technically ADA compliant, I can barely open the door. This is one of the biggest problems we face as disabled people: ADA compliance ≠ actual accessibility. The ADA sets the minimum requirements or the bare legal standard. But those standards don’t always translate to real usability for everyone. We can book an accessible room and still end up in a space where we can’t open the door without a big struggle, The bed is so high transfers are super difficult or dangerous, and where the space is so tight we can’t turn our wheelchair around. ADA was a huge win when it passed in 1990. But it hasn’t had a ton of change since. This isn’t about luxury. This morning it was stated that the DOJ removed “scrubbed” 11 guidelines from the ADA. So now you are saying, “okay and?” Well 5 of them were related to COVID-19 while the remaining 6 applied to retail, gas and lodging, including improvements, customer service, and accessibility feedback. Expanding Your Market: Maintaining Accessible Features in Retail Establishments (2009) Expanding Your Market: Gathering Input from Customers with Disabilities (2007) Expanding Your Market: Accessible Customer Service Practices for Hotel and Lodging Guests with Disabilities (2006) Reaching out to Customers with Disabilities (2005) Americans with Disabilities Act: Assistance at Self-Serve Gas Stations (1999) Five Steps to Make New Lodging Facilities Comply with the ADA (1999) Now incase you’re still wondering why this is a big deal, I’ve added a video for an example.
