The Supreme Court says gun laws must be judged by “history and tradition.” But here’s the problem… Part of that history includes the Black Codes, laws passed after the Civil War that were designed to disarm Black people and keep them powerless. So when courts rely on “history,” we have to ask: whose history are we using—and who did it harm? Mass Incarceration is the birth child of the abolishment of slavery. The 13th Amendment states, “The abolishment of slavery, except punishable by a crime.” Yes people slavery is still legally written into our constitution. It was no coincidence that when slavery “ended”, mass incarceration began. Slave labor was such an integral component of the southern economy that incarceration was the loophole to ensuring racists business owners still had free labor. The South literally creates Black Codes that arrested Black people for loitering, not having a job when no white person would hire them, being out past curfew, and much much more. The biggest thing I hear people say who look like me is that was over 100 years ago. Are you really going to talk about that today? Yes I am. Slavery never ended. I, too, became a part of this scheme as collateral damage in a system that wasn’t even designed for me. I, too, became a victim of the injustices of the system spending a decade behind the fence. I faced trumped up charges in which I was over-sentenced with harsh penalties. Many people use my experience as proof that the system isn’t racist because I also experienced the injustice. However, this only solidifies the point. Evening the scoreboard isn’t the answer. In the age of “color blindness” The Prison Industrial Complex devours anyone who is poor regardless of race. Many white people will use this as justification that racism ended. Racism is the birth child of Classism. Don’t conflate the too. The tree was planted with the intention of poisoning the community. That same tree as stood over the Black community blocking out any chance of sunlight being able to shine through. And any residual effects we feel today are what most lawyers would define as “the fruit of the poisonous tree.” If you’re white and here, I ask that you don’t get defensive. In August 1851, William Dungey, a dark-skinned young man of Portuguese descent, married Joseph Spencer’s sister. A family quarrel ensued, which became so bitter that in January 1855, Spencer claimed throughout the community that his brother-in-law, ‘Black Bill,’ was a Negro. Lincoln filed his declaration charging Joseph Spencer with slander on April 17, 1855, and sought $1,000 in damages. On October 18, 1855, the jury returned a verdict of guilty and granted Dungey $600 in damages plus court costs of $137.50. Lincoln famously stated, “‘My client is not a Negro, though it is a crime to be a Negro–no crime to be born with a black skin. But my client is not a Negro. His skin may not be as white as ours, but I say he is not a Negro, though he may be a Moore.’ ‘Mr. Lincoln,’ interrupted Judge Davis, scarcely able to restrain a smile, ‘you mean a Moor, not Moore.’ ‘Well, your Honor, Moor, not C.H.
