The Fourteenth Amendment to the United States Constitution is one of the most important amendments in U.S. history. It was ratified in 1868 after the Civil War and was created largely to protect the rights of formerly enslaved Black Americans.
It has several major parts, but the key ideas are:
* Citizenship: Anyone born or naturalized in the United States is a U.S. citizen.
* This overturned the Supreme Court’s Dred Scott v. Sandford ruling, which had said Black people could not be citizens.
* Equal Protection Clause: States must give people “equal protection of the laws.”

HIAlabama House Speaker Nathaniel Ledbetter addressed reporters after the final passage of SB1 and called for the courts to overturn the 14th Amendment, according to the press conference clip.
SB1 is part of Alabama’s latest redistricting fight.
Nearly 400 people rallied outside the Alabama State House after Gov. Kay Ivey called the special session, with voting rights groups and residents warning that the redistricting push could weaken Black political representation ahead of the primaries and midterms.
Groups involved included Black Voters Matter, the ACLU of Alabama, the Southern Poverty Law Center, and Alabama Forward.
Alabama’s redistricting record is already under national scrutiny. In Allen v. Milligan, the state’s congressional map was challenged for diluting Black voting power, and the U.S. Supreme Court upheld a lower court ruling that Alabama likely violated Section 2 of the Voting Rights Act.
After passing SB1 over public opposition, Alabama’s House Speaker openly called for the courts to overturn the 14th Amendment, one of the Constitution’s core civil rights protections tied to equal protection under the law. For Black Alabama voters, this is the same state, the same fight over representation, and now a top legislative leader taking aim at the amendment meant to protect people from unequal treatment by the government.

The Supreme Court’s conservative supermajority often rely on “originalism,” professing to apply the Constitution as they believe the founders intended—and did so to issue rulings eroding Americans’ rights to abortion and gun control.
On Tuesday, during her second day of arguments as a Supreme Court justice, Ketanji Brown Jackson applied this same originalist approach in an area where her conservative colleagues avoid it. In a case out of Alabama that threatens to gut critical protections for voters of color, she delivered a history lesson on the original purpose of the 14th Amendment—laying out the background behind the clause to explain why it actually supports robust enforcement of voting rights.
In oral arguments in a case called Merrill v. Milligan, Alabama argued that the 14th Amendment, passed in 1868 to ensure citizenship and equality under the law for people freed from slavery, is in conflict with the Voting Rights Act, which requires drawing political maps with race in mind, in order to give minority groups often clustered in particular regions an equal shot at political participation.
Alabama’s contention is that the Equal Protection Clause of the 14th Amendment is in tension with this element of the Voting Rights Act: The 14th Amendment mandates race blindness while the VRA requires taking race into account.
