Did you know that the Constitution of India allows the government to take extraordinary powers during national crises? ⚠️🇮🇳 These powers are called Emergency Provisions, and they are mentioned in Articles 352–360 of the Constitution of India. The Emergency Provisions in the Constitution of India allow the Central Government to take special measures during serious crises to protect the country, maintain stability, and ensure governance. During an emergency, the powers of the Union Government increase, and in certain situations some Fundamental Rights may be restricted. These provisions are covered under Articles 352 to 360 of the Constitution. ⚖️ Types of Emergency in India 1️⃣ National Emergency 📜 Article: Article 352 of the Constitution of India A National Emergency can be declared when: • War • External aggression • Armed rebellion The President of India declares it on the advice of the Union Cabinet of India. ✔ The Central Government gets more control over states. ✔ Certain Fundamental Rights may be restricted. 📌 Example: The Indian Emergency (1975–1977) declared by Indira Gandhi. 2️⃣ State Emergency / President’s Rule 📜 Article: Article 356 of the Constitution of India This emergency is declared when constitutional machinery fails in a state. • The President takes control of the state government. • The state legislature may be suspended or dissolved. 📌 Important Case: The S. During a National Emergency, the Fundamental Rights guaranteed under Article 19 are automatically suspended. However, the Fundamental Rights protected under Articles 20 and 21 remain enforceable and cannot be suspended even during such an emergency.
