राजस्थान हाईकोर्ट का बड़ा फैसला | Maintenance Law Explained
राजस्थान हाईकोर्ट, जोधपुर बेंच ने भरण-पोषण (Maintenance) से जुड़े एक महत्वपूर्ण मामले में स्पष्ट किया है कि पति की अधिक आय होने मात्र से पत्नी को उसकी कमाई का आधा या बड़ा हिस्सा देने का कोई कानूनी अधिकार नहीं बनता।
यह फैसला Ritu Khatri बनाम Navneet Khanna मामले में दिया गया, जिसमें पत्नी ने फैमिली कोर्ट द्वारा तय ₹8,000 प्रतिमाह भरण-पोषण को कम बताते हुए हाईकोर्ट में बढ़ाने की मांग की थी। पत्नी का तर्क था कि पति की मासिक आय ₹1.5 लाख से अधिक है, इसलिए भरण-पोषण बढ़ाया जाना चाहिए।

RODeclaring false income to court in maintenance cases is a punishable offence !
In a recent case before the Supreme Court of India, a husband claimed he earned only ₹325 per day (around ₹9,000 per month) and therefore could not pay ₹12,000 maintenance to his wife.
But the Court wasn’t convinced.
The judges questioned whether such an income claim was believable in today’s time and even said that, if required, the employer could be summoned to verify the real salary.
Because in maintenance cases, courts don’t rely only on salary slips.
They look at earning capacity, lifestyle, and actual financial ability.
Also remember — in maintenance cases, income must be disclosed on oath.
If someone hides or misrepresents their income, it may amount to perjury, which can even lead to criminal prosecution and imprisonment.
