If a cop knocks and asks, โ€œDo you mind if we come in and talk?โ€ โ€” thatโ€™s not small talk. Itโ€™s a consent trap. Your home is protected under the Fourth Amendment. Police need a warrant, exigent circumstances, or your consent to enter (Payton v. New York). So instead of forcing entry, they ask for permission. Hereโ€™s the danger: Under Schneckloth v. Bustamonte, consent only has to appear voluntary. And in California, People v. James allows courts to treat stepping back, opening the door wider, or gesturing inside as valid consent. Once theyโ€™re inside, anything in plain view can be used against you โ€” and challenging entry later becomes extremely difficult. You are NOT required to answer investigative questions at your door. The safest response: โ€œI do not consent to entry, and Iโ€™m not answering questions.โ€ Say it calmly. Say it clearly. Keep the door closed. The Constitution asks one question first: did the officer have a lawful basis to search at the moment it happened, before anyone knew what would turn up. Probable cause, a valid warrant, consent, or some other warrant exception have to exist on the front end. Finding contraband after the fact doesnโ€™t cure a bad stop or an illegal search, it exposes one.
