Liam and his father were detained in a Minneapolis suburb on January twentieth and held for ten days in a Texas detention center before a judge ordered their release. The family’s lawyers say Adrian entered the country legally and requested asylum, giving him the right to remain while his case was decided. The government claims he entered illegally, and that dispute goes to the heart of whether this family ever had a fair chance. During the arrest, neighbors and school officials accused immigration officers of using Liam as bait, telling him to knock on his own front door so his mother would come outside. The Department of Homeland Security called that an outright lie, but the image of a kindergartner caught in an enforcement operation has not left public memory. 📄 The operations in Minneapolis that swept up this family also led to the shooting deaths of two American citizens by federal officers. Liam is back in school now, but his lawyer says the family is scared about what comes next. The fight is not over. Attorney Danielle Molliver told Minnesota Public Radio that the family is appealing the ruling to the Board of Immigration Appeals (BIA). The decision is the latest step in the Trump administration’s effort to deport the five-year-old child, whose photograph in a bunny hat in Minneapolis went viral after he and his father were detained by immigration officials in January. The family “is very disappointed”, Molliver told the Minnesota Star Tribune. “They were hopeful, at the minimum, they would get their day in court and have an audience and present their testimony.” Trump administration is deporting parents without their children in violation of its own policies, report finds The family, including Liam’s 13-year-old brother and their parents, Adrian Conejo Arias and Erika Ramos, who is pregnant, faces an uncertain future as the Trump administration moves to expedite the removal of the child and his father. The Department of Homeland Security (DHS) has previously denied the claim that they are looking to fast-track the removal.

An immigration court judge handed down the decision on Feb. 19, one of the family’s attorneys, Paschal Nwokocha, tells PEOPLE. But he says the family shared that information publicly for the first time on Wednesday, March 18, with Minnesota Public Radio, which was first to report the development. Nwokocha says he has asked the Board of Immigration Appeals, a branch of the Justice Department, to send the case back to the immigration court to hear the merits of the family’s asylum claim. An appeal could take months or years, he says, and if the family loses the appeal, they could be deported to Ecuador, where they are from. @people
