⚖️ I voted 𝗮𝗴𝗮𝗶𝗻𝘀𝘁 curtailing the right to Jury Trials. The right to a trial by jury is central to the English legal system. The Labour party seem to take delight in tearing up long-held principles that underpin our constitution simply because it is politically expedient to do so. They are shredding our constitution without much thought as to the consequences.

The government wants to scrap jury trials for all but the most serious cases, to restrict defendants' right to elect for a jury trial, and to limit appeals from the magistrates’ court. This is despite the Justice Secretary, David Lammy, previously calling jury trials “fundamental to our democracy”. Juries are the way in which the public consents to, and participates in, the exercise of the State's power to deprive people of their liberty. They are not 'red tape' or unnecessary bureaucracy. I have already spoken in opposition to this plan in the House of Commons, where I described it as "constitutional vandalism". Scrapping jury trials is not the answer to clearing backlogs in the Crown court system. The Criminal Bar Association, the Bar Council and the Law Society have all warned that removing jury trials is a distraction from tackling the real issues. I will continue to oppose the government's hugely flawed policy.

The Government’s plans to scrap jury trials in parts of the justice system are fundamentally wrong. Jury trials have been a cornerstone of English justice for around 800 years. It is one of the most important safeguards we have against the power of the state. And what would scrapping it achieve? Even on the Government’s own estimates, it would reduce the court backlog by just 2%. We need to tackle the backlog in our courts. But gutting a fundamental right for such a tiny impact is the wrong answer.

In a speech in parliament I called for all prison staff to be given full protective body armour – as incidents of violence against them reach a record high. Assaults have almost trebled in the last decade with national figures showing more than 10,500 incidents in the 12 months to March 2025. Of those 26 per cent involved improvised weapons, while the rest involved blunt force or liquids such as hot oil or boiling water. Life as a prison officer, even at the best of times, is extremely challenging. They must confront and contain unthinkable situations almost daily. To do the job, they must possess a level of bravery that most of us simply do not have. But to do the job without proper protective gear is beyond belief. Protective equipment and clothing should be provided irrespective of the category of prison. Sadly, violence can happen in all types of prison. Figures from the Ministry of Justice and His Majesty’s inspectorate of prisons consistently show that local prisons, which are mostly category B rather than A—the high-security ones—have extremely high numbers of assaults. Although the lower categories of C and D have less violence, the risk can still be considerable, and it is rising. Figures for local women’s prison and young offender’s institute Styal, in my constituency, has also show an increase in violence with 189 assaults on staff and 167 assaults between prisoners in the 12 months to March last year. A recent survey of staff by the Prison Officer’s Association found 74 per cent want slash and bite proof vests - and you can understand why when you hear of the number of attacks against them. Let’s make sure our prison officers get the protection they need.

The Unduly Lenient Sentencing scheme allows the public and prosecutors to request a review of certain Crown Court sentences in England and Wales if they believe they are too low. If the Law Officers determine those cases are unduly lenient, the case can be referred to the Court of Appeal to be increased. Speaking in the House today, the Solicitor General Ellie Reeves KC MP outlined how, in the last six months, 30 offenders – responsible for some of the most serious crimes – have had their sentences increased under the Unduly Lenient Scheme following her intervention. #ULS #UndulyLenientScheme

During the Bill's progress through Parliament, the Conservatives said that it would lead to fewer criminals serving jail time - although the government said many of its measures were a consequence of inheriting a prison system "bursting at the seams". A Ministry of Justice spokesperson said that the measures would not abolish short sentences and would "make sure prisons never run out of space again, while strengthening the supervision of the most dangerous offenders." Riel Karmy-Jones KC, chair of the Criminal Bar Association, said the reforms would make an almost immediate impact, including on court backlogs because they would encourage defendants to plead earlier. "The pressure on prisons will be lessened, with more places available for those serving longer terms, especially violent and sexual offences, together with providing them with the additional rehabilitation services. "This is an important measure, as it will help to prevent them from reoffending when finally released, ultimately providing the best protection for the public." The legislation does not define what would count as exceptional circumstances for a court to jail an offender - leaving that for magistrates or a judge to decide. An associated change to bail rules means that defendants who are likely to receive a suspended sentence, if later convicted, will be less likely to be held in jail on remand ahead of a trial. At present more than 16,000 people are being detained on remand - about a fifth of the total jail population. Another measure coming into force allows a court to defer passing a sentence for up to 12 months - double the current permissible delay - where it thinks it will give an offender time to address problems in their life at the heart of their criminality - such as drug addiction.

The Courts and Tribunals Bill has many good aspects but includes denying defendants the right to a jury trial. There's no proof this will reduce the case backlog. There are better ways to do so. I can't support this as it's drawn. I'll abstain and urge the govt to amend the bill.
