Lately, we’ve been seeing more and more people come to us asking about the difference between legal separation and divorce. With the cost of living rising, housing challenges, and healthcare costs increasing, many families simply aren’t in a position to fully untangle their lives right away. Maybe you can’t afford to live separately yet. Maybe buying someone out of the house isn’t realistic. Maybe staying on a spouse’s health insurance matters right now. Or maybe, as a family, you’ve decided divorce just isn’t the right next step — yet. And that’s okay. 💛 Many couples live separately for years through informal agreements while remaining legally married. But if that’s the path you’re taking, it’s important to know this: there may be a way to protect yourself legally and financially while also giving yourself a head start if divorce becomes the next chapter. A separation agreement can help you: ✨ Set clear boundaries while living separately ✨ Create agreements around finances, support, and parenting ✨ Protect yourself legally and financially ✨ Potentially make the divorce process smoother later by using that agreement as a foundation Every family is different, and there is no one-size-fits-all answer. 🎥 Head to the link in our bio to watch our full Divorce Den YouTube conversation on this topic — and if you want to explore what option may be best for you, you can also book a consultation with us there. #VazLaw #LegalSeparation #DivorceInNewYork #DivorceDen #SeparationAgreement

Divorce is already expensive. The mistakes you make during it don’t have to be. Most people lose money not because they have to — but because they don’t know where they’re vulnerable. They agree too fast. They don’t fully understand the finances. They make decisions in emotional moments. That’s exactly why I created the Divorce SOS Risk Checker. It shows you where you’re most at risk — before it costs you. It’s free, and opening soon. Please read this before you move out of the family home. I know staying feels impossible. But leaving too soon can seriously affect your legal position — your claim to the property, your children’s stability, your negotiating power. If there’s a safety concern — leave. Always. Your safety first. Otherwise — speak to a lawyer before you sign a lease. One conversation could save you years of regret. Most people think divorce is a legal process. It’s legal, financial, and strategic. And this is where people lose money without even realizing it. There are three key professionals that should be part of your separation plan: • Accountant → to navigate tax implications, benefits, and credits • Financial Advisor → to rebuild your financial structure and long-term strategy • Lawyer → to finalize the legal agreement When these three aren’t working together, gaps get missed. And those gaps can cost you, sometimes for years. I’ve seen it. I’ve lived parts of it. Your lawyer handles the agreement. But your financial life? That requires a bigger plan. Divorce isn’t just about dividing assets. It’s about protecting what happens next. If you’re navigating separation and want to understand how this should actually be structured, send me a message or comment “PLAN” and I’ll walk you through it. Most women think the divorce fixes everything. It doesn’t. Divorce only ends the marriage. It does not end the financial relationship between you and your former spouse. Unless the property settlement is formally finalised - usually through Consent Orders or a Binding Financial Agreement - the door can remain open for a future claim. And that claim doesn’t just relate to the assets you had when you separated. It can reach into the life you build after. The house you buy later. The business you start. The super you grow. The investments you accumulate. I’ve seen women spend years rebuilding financially after separation… only to discover the legal door was never properly closed. The divorce certificate feels like the end. Legally, it often isn’t. And the longer it’s left unresolved, the messier - and more expensive - it can become. This is one of the most common mistakes I see after separation. Not because women are careless. Because no one explains the difference properly. 👉 If you’re separated or divorced and never formally finalised property settlement, this is something worth understanding sooner rather than later. Save this post so you remember. And if you know a woman rebuilding her life after separation, send it to her. It might protect everything she’s working so hard to rebuild. #divorcelawyer #divorce #divorcesupport #divorceadvice #legaladvice

If you’re considering separation or divorce, do these three things first: 1. Get your tax returns - Last 5 years for personal, 3-5 years if there’s a business involved (yours or your spouse’s). These show where accounts are, what income looks like, and your marital standard of living. 2. Open accounts in your name - Bank account + credit card. Credit shifts after divorce and you need to be prepared if things change. 3. Start booking attorney consultations - But prepare BEFORE you meet with them so you actually know what to ask and how to make the most of those meetings. Most people walk into attorney consultations completely unprepared and waste time (and money) asking the wrong questions. I created a free guide with 24 questions to ask a divorce attorney or mediator - plus a place to log all the details from each consultation so you stay organized throughout the process. I'm proud to say it's recommended by divorce attorneys and mediators. Comment “24Q” and I’ll send you the link to download. ✌️ Alex

Divorce and property settlement are not the same thing. Divorce simply ends the marriage. That’s it. It doesn’t divide assets. It doesn’t finalise financial ties. And it doesn’t protect the assets you may build in the future. Unless a formal property settlement is properly documented - usually through consent orders or a binding financial agreement - your financial relationship with your ex may not actually be finished. Which means that current and even future assets can remain legally exposed. Many people assume that once the divorce certificate arrives, everything is finalised. But legally, that’s not how it works. Divorce ends the marriage. A formal property settlement ends the financial relationship. And if that step is missed, the consequences can surface years later when circumstances change. Which is why understanding the difference matters. 👉Save this post if you think more people should understand the difference between divorce and property settlement. It’s one of the most misunderstood areas of family law. 👉 Send us a DM if you need professional help navigating your divorce or separation. #divorceadvice #divorcelawyer #divorce #familylaw #familylawyer

One of the most common things we hear from clients is: “I thought the divorce covered everything.” In Australia, divorce is actually a very specific legal step. It formally ends the marriage, but it does not resolve property settlement or parenting arrangements. Many people delay applying because they feel overwhelmed by the process or aren’t sure where to start. To make this easier, we’ve introduced a new fixed fee divorce package where you can arrange your consultation and begin the application process online. For many people, filing for divorce isn’t about conflict. It’s simply about closing one chapter so the next can begin 🫶🏻 If you’re ready to take that step, you can book directly through the link in our bio.

A ‘no-split divorce’ happens when couples decide to legally end their marriage but can’t actually move out of the family home. 🏠 Maybe neither partner can afford to buy the other out, or living on one income just isn’t possible at that time. They separate emotionally and practically, sometimes even starting the divorce process, but still stay under the same roof. For some it’s just a few weeks but for others it could last months, even a year. But it’s not a long-term solution. Living together after your marriage has ended can cause serious strain, increase stress and upset, and blur the lines between being married and separated - impacting your ongoing relationship with your ex. Sometimes the only way forward is to truly create space if and when you can… #divorcecommunity #divorcesupport
