As an advocate, I am not here to push a placement. I am here to make sure the placement actually meets the child’s needs. Under the Individuals with Disabilities Education Act (IDEA), placement is not about a location or a label. It is about where a student can receive a Free Appropriate Public Education (FAPE). That requirement is found in 34 C.F.R. 300.114 through 300.116. And here is the part people miss… Least Restrictive Environment does not automatically mean general education. LRE means the student should be educated with non-disabled peers to the maximum extent appropriate. Those last two words matter. Appropriate. If a student is sitting in a general education classroom and: they are not accessing instruction they are not making meaningful progress they are in constant distress their supports are not being implemented with fidelity that is not LRE. That is a denial of FAPE. Sometimes the least restrictive environment is a smaller setting. Sometimes it is a special class. Sometimes it is a specialized program. Because the goal is not proximity to peers. The goal is meaningful benefit. And here is the truth most families learn the hard way… sometimes it is the school resisting the change in placement, not the advocate pushing for it. Why? Because changing placement can require more resources, more staffing, or acknowledgment that the current program is not working. But IDEA is clear. Placement decisions must be based on the child’s individual needs, not convenience, not staffing, and not district policy. 34 C.F.R. 300.116. So no… we are not fighting to keep kids in general education at all costs. We are fighting to make sure they are in the environment where they can actually learn, make progress, and access their education. It must be based on real data and designed to enable progress that is appropriate in light of your child’s unique circumstances. FAPE is not perfection. It is not doing the bare minimum. Passing grades alone are not enough. Your child’s program must be ambitious, meaningful, and aligned with their needs. Endrew F makes this clear. In 2017, the Supreme Court ruled unanimously in Endrew F. v. Douglas County School District. The decision changed the legal standard for what a "Free Appropriate Public Education" actually means. Before Endrew F., some courts accepted IEPs that provided only minimal educational benefit. After Endrew F.? IEPs must be "reasonably calculated to enable a child to make progress appropriate in light of the child's circumstances." That's not minimal progress. That's not barely moving forward. That's meaningful, ambitious, child-specific progress. If your child's IEP goals are vague, flat, or recycled from year to year — cite this case. By name. In the meeting. Calmly. Newsflash: BOTH can be true👇 ✅ General educational students have a right to a safe, uninterrupted learning environment. ✅ A student with a disability ALSO has a right to a Free Appropriate Public Education (FAPE) in the Least Restrictive Environment (LRE)… as the placement doesn’t interfere with others’ learning (or their own). That means both students have rights—and when either one is losing learning time, the school is violating somebody’s legal protections. So if your child is being hit, threatened, or constantly disrupted in class... That’s not a failure of inclusion. That’s not a “bad kid” problem. That’s a failure to follow SPED law. Here’s what the law actually requires: 🔍 A Functional Behavioral Assessment (FBA) must be conducted to understand behaviors (IDEA §300.324(a)(2)(i)) 🧠 A Behavior Intervention Plan (BIP) must be implemented and reviewed regularly ⚖️ A Manifestation Determination Review must be done for disciplinary actions (IDEA §300.530) 🚫 LRE must be decided based on whether supports can allow the student to remain without disrupting the learning of others (OSEP Letter to Smith, 1994) This isn't about choosing between kids. It's about holding districts accountable for skipping steps that protect EVERYONE. (+including staff‼️) 📌 Parents: Take notes. 📌 Educators: Know your legal backup. 📌 Districts: Follow the law.
