LATen associations filed a complaint
against the Ministry of the Interior
over systematic failures of the ANEF
platform — the only way to apply
for a French residence permit.
The Conseil d’État ruled in their favour.

What the state was ordered to fix:
Within 12 months:
→ ANEF must allow applicants to submit
multiple applications on different
legal grounds simultaneously or
sequentially — so that a person can
claim all their rights, not get
stuck on a single ground
Within 6 months:
→ Allow users to report errors,
update their data (including address)
and add new documents to their file
when needed for the review process
→ The attestation de prolongation
de l’instruction must be issued
before the previous titre expires
and renewed automatically —
without requiring the applicant
to request it
Additionally:
→ Bring the system into compliance
so that platform failures do not
block access to social rights
and housing
→ Clarify the attestation de décision
favorable — its ambiguity was
preventing people from proving
their right to work
The key legal principle of the ruling:
When use of a digital service
is mandatory — the state cannot
hide behind « technical difficulties ».
It is legally required to guarantee
real access to the procedure
and to the rights it governs.
ANEF failures are no longer
just a daily inconvenience —
the Conseil d’État has recognised them
as a legally significant obstacle
to the right of residence,
the right to work, and access
to social rights.
What the ruling does NOT say:
The court did not abolish
the mandatory digital filing
through ANEF.
And it did not declare every bug
automatically unlawful —
the decision specifically identifies
the failures it found
sufficiently proven and
legally significant.
