A case brief is a short, structured summary of a court judgment that helps you understand:
What happened
What legal issue was involved
What the court decided
Why the court decided that way
It turns a 40-page judgment into 1–2 clear pages.
🧾 Standard Format of a Case Brief
1️⃣ Title & Citation
Example:
Kesavananda Bharati v. State of Kerala (1973)
Includes:
Case name
Year
Court
Citation number
2️⃣ Facts of the Case
👉 What happened?
Background story
Parties involved
Key events
Keep it short and relevant (no unnecessary storytelling).
3️⃣ Issues
👉 What legal question did the court need to answer?
Usually written as:
“Whether…?”
“Is the Parliament empowered to…?”
4️⃣ Arguments
👉 What did both sides argue?
Petitioner’s argument
Respondent’s argument
(Short summary only)
5️⃣ Judgment / Holding
👉 What did the court decide?
Who won? What was the final ruling?
6️⃣ Reasoning (Most Important Part)
👉 Why did the court decide that way?
Legal principles applied
Interpretation of law
Precedents used
This is where professors focus 👀
7️⃣ Ratio Decidendi
👉 The legal principle laid down (binding part).
Example:
Basic Structure Doctrine (from Kesavananda Bharati case)
8️⃣ Obiter Dicta (If any)
👉 Additional observations not binding but persuasive.
