BEKapil sibal’s - Remark on CAA at parliament
After the bill was passed by both Houses of Parliament, Kapil Sibal criticised it strongly, saying that just because Home Minister Amit Shah or the government said it was valid, that doesn’t make it valid under the Constitution. He stressed the matter needed to be decided by the Supreme Court.
Sibal highlighted that religion shouldn’t be a criterion for citizenship in the Indian Constitution. The Citizenship (Amendment) Bill/Act provides a path to citizenship for non-Muslim minorities from Pakistan, Bangladesh and Afghanistan, which he said was not consistent with constitutional principles.
During debate in the Rajya Sabha, Sibal engaged in a sharp exchange with Home Minister Amit Shah. Shah claimed opposition leaders had said CAA would take away the citizenship of minorities; Sibal replied that nobody was claiming that outright, and instead emphasised that the real issue was the National Population Register (NPR) and how people could be marked as “doubtful citizens” under it.
Although this was outside the Parliament floor itself (a later public comment), Sibal said that if CAA became law, states cannot constitutionally refuse to implement it. He explained that state governments might pass resolutions opposing it, but legally they cannot simply refuse to administer a law passed by Parliament.
While not a direct quote from Sibal’s speeches, many critics (including Sibal) said that because the bill uses religion as a basis for giving citizenship rights, it could instil fear in minority communities and change perceptions about equality and secularism in India.
