The difference between a phrase you can trademark and one you can’t comes down to: is it descriptive of what everyone in your industry already does, or is it actually distinctive? “6 figure toolkit” is a description of a resource that helps you reach six figures. It tells people exactly what it does using common industry language.​​​​​​​​​​​​​​​​ That’s why it’s not trademarkable. But if you make up a word or create a phrase that doesn’t obviously describe what you do, you’ve got a shot. Think brands like “Peloton” or “Lululemon.” No one else was using them. That’s the goal. If someone in your industry could use the same phrase to describe their business without copying you, it’s probably too common to trademark. Most people don’t figure this out until after they’ve paid filing fees and waited months for a rejection letter. In fact, did you know that someone else in another state can have the same LLC name as yours 😮 This means that they could potentially beat you to the trademark punch, file [and get] the registered trademark, and force you to rebrand. If your business name is your Instagram handle and someone trademarks it in your industry first, your handle and all of your followers could be taken from you just like that. If you have a business name, podcast name, mastermind name or course name that you’d be upset if you had to change, a federal trademark is the only way to have the exclusive right to that name in your industry. That’s right—your LLC, Instagram handle, and domain name don’t actually give you ownership. Only a registered trademark gives you the exclusive right to use your brand name nationwide. If you want to fully own your brand in all 50 states—and have legal ground to stand on when someone tries to rip it off—it starts with filing.
