Forfeiting their rights to a spouse’s 401(k). It usually happens in uncontested divorces, where both spouses want to move on quickly and avoid conflict. They agree on custody, the house, even the cars… But when retirement accounts come up, one spouse says, “That’s their account. I don’t want to start a fight.” But, retirement accounts are often the largest marital asset a couple owns, especially after 20+ years together. Even if the account is only in one spouse’s name, the portion earned during the marriage is considered marital property in most states. What happens when retirement accounts are ignored: 1. The divorce agreement is finalized without addressing the 401(k). 2. The plan administrator never receives a court order to divide it (a QDRO). 3. Years later, one spouse retires while the other realizes they’ve lost out on decades of shared savings. When I work with clients, I make sure retirement assets are discussed early and clearly, before anything is signed. I’ve had a day. And if you’re in family court right now, I know you probably have too. Here’s the truth no one loves hearing: You can be frustrated with the system. You can think it’s inefficient. You can think it doesn’t make sense. All of that can be true at the same time as this 👇 There are things you are required to do in a family law case. Mandatory disclosure. Mediation. Addressing issues you don’t think should even be on the table. You don’t get to opt out just because you don’t like them or don’t understand why they matter. That’s not how this system works. And here’s where I need to be very clear: 👉 Your lawyer is not the villain for telling you to follow the rules. 👉 Your lawyer is not “slowing things down” by insisting you do what the court requires. 👉 Your lawyer cannot bypass steps just because you’re fed up. Frustration with the process? Completely valid. Taking it out on the person trying to guide you through it? Misplaced. Family court is procedural. Whether you agree with it or not, the rules still apply. Fighting the process only makes your case harder—and more expensive. This isn’t about blame. It’s about reality. i hope she knows how thankful i am that she has the courage to make the hard decisions that weren’t pretty all those years ago so we can live this life now i hope she knows i look up to her for being so strong and breaking her own heart to heal and i hope she knows i still think about her even when im happiest and healthy and especially when i feel so loved i remember wondering what life would look like after, how things would change, how i would be different. who i would become on my own as i left a place, person, moment, and celebration. and now, after the adventure and the changes and the moving away and learning - it was worth every moment of doubt, uncertainty, denial and fear. life was been wonderful since then, in so many different ways. it’s been really mf hard, in so many new ways, but it has been the best version i’ve created for myself and sometimes i sit back and i just can’t believe that we actually made it this far and continuing to sludge through it for whoever, whenever, however, trust yourself and go. find something new whether it be a place, a hobby, a discovery - pick it for yourself, do it for yourself. remember you can try and change your mind. you can pick something up and put it back down. you can love something and not be great at it but if your heart is in it, that’s the experience. and my usual reminder - you can be happy and sad at the same time. you can mourn a loss and celebrate a beginning. you can grow, even if it feels like losing. cry. journal. remember the moments you thought would last an eternity. capture the times you’re happiest and loved. this is the human experience and there is no playbook #harddecision #choosingyourself #divorceprocess #realityoflife startingoveragain
