Until now, it was Trump vs other countries. Now, it seems like it’s Trump vs his own country the Supreme Court, Congress, and the world.
The U.S. Supreme Court recently ruled that Trump cannot impose tariffs unilaterally under emergency powers, as that authority lies with Congress. Previously, he had used the International Emergency Economic Powers Act to justify tariffs.
In response, Trump says he will still impose tariffs even a 10% global tariff using the Trade Act of 1974, which has three key sections:
•Section 232: Tariffs for national security reasons (used on steel and aluminum in his first term).
•Section 301: Action against unfair trade practices (used in the U.S.–China trade war).
•Section 122: Allows up to 15% tariffs for 150 days to address trade imbalances. Trump plans to use this for a 10% global tariff.
To justify these actions, claims of national security or unfair trade practices are needed, which could increase geopolitical tensions.
Negotiating with someone like Trump is difficult, India’s diplomats had to work hard to reduce tariffs significantly in past deals. Now, it remains to be seen how Trump will handle other countries while dealing with the Supreme Court and Congress at home.
