🚨Lost your Job? How much Money should you get?? You could lose your job tomorrow… and still not know what your company legally owes you. That’s the scary part. Most employees think severance means: “1 month salary and done.” Reality? It can be much bigger. And companies know most people won’t question it. Recently, thousands of employees woke up to layoff emails overnight. No meetings. No warning. Just: “Your role has been eliminated.” And then comes the pressure: “Sign this document.” “Accept the settlement.” “This is the final amount.” But very few people actually stop and calculate what they should legally receive. Here’s what may be included in a layoff settlement: 1. Retrenchment Compensation 15 days salary for every completed year of service. Worked 5 years? That alone can mean ~75 days salary. 2. Gratuity Another 15 days salary per year based on your last drawn salary. But only if you completed 5 years. 3. Notice Pay + Leave Encashment Notice period salary + payment for unused leaves. Now calculate that together for a long-term employee: - Retrenchment compensation - Gratuity - Notice pay - Pending leaves The number becomes much more than most people expect. But there’s a big catch. Retrenchment laws mainly protect “workmen” under labour law. Managers, senior employees, leadership roles, many white-collar professionals may not fully qualify. Which means your real protection is often: Your employment contract. That offer letter you ignored? That severance clause nobody reads? That notice period section? Those become extremely important during layoffs. And in uncertain times, this is something every working professional should understand. Before signing any settlement: - Read the breakup carefully - Check gratuity eligibility - Verify leave encashment - Understand notice pay clauses - Don’t sign under pressure Because one rushed signature can cost you lakhs. The Gratuity Act states that the employee can enjoy the Gratuity amount only after completing 5 years of uninterrupted service! And guess what, this amount is TAX FREE (up to INR 30,00,000 as per the amendment introduced in the Financial Budget 2019) Here are some more things you need to know about Gratuity: All employers must comply with the Gratuity Act to pay employees their Gratuity amount at resignation, retirement, disablement, or death. The employer has a right to reject the gratuity payment of an employee in case their services have been terminated for fraud, misconduct, or any other illegal matters. Gratuity is applicable to firms/organisations that have 10 or more employees. Also, if an employee have had an unfortunate incident that has left them disabled or dead (this can also be outside company property), even if the employee has not completed 5 years of continuous services, they are eligible for full payment of gratuity to either the employee or the nominee. No matter how frustrated you are, it may be worth sticking it out, to get this payout! Because then the company can avoid paying you ₹3–5 lakh in gratuity 💰 But most employees don’t know this 👇 ⚖ Supreme Court’s Surendra Kumar Verma (1980) judgment says: 240 working days = completed year Meaning many employees become eligible even before full 5 calendar years. This comes under the Payment of Gratuity Act, 1972 👇 If you leave after completing eligible service, the company is legally required to pay gratuity. But many companies try to push employees out at 4 years 10–11 months 😶 ✅ 3 Things You MUST Know: 1️⃣ Complete at least 4 years 8 months Sundays, paid holidays, casual leave & sick leave are counted too. 2️⃣ Submit Form I Apply within 30 days after leaving the company. 👉 Example: Basic salary ₹40,000 = gratuity can reach lakhs. 3️⃣ HR refuses? Go directly to the Labour Commissioner.
