A recent federal case, United States v. Heppner, is a wake-up call for anyone using generative AI. In this February 2026 decision, the court ruled that a defendant’s interactions with a public AI platform were not protected by attorney-client privilege or the work-product doctrine. That means those conversations were discoverable by the government. The reasoning is straightforward. Privilege depends on confidentiality, and using a public AI tool involves sharing information with a third party. The court made it clear that AI is not your lawyer, and those communications are not protected in the same way. The takeaway is simple but critical. Do not assume your AI conversations are private, especially when discussing legal strategy or sensitive facts. If it matters, talk to your attorney, not a chatbot. #litigation #attorneyclientprivilege #legaltips #aiandlaw #confidentiality lawyerlife

1. Nothing is impossible to resolve in litigation. If one route doesn’t work, try another. File applications, explore different provisions, somewhere, it will fit. 2. Litigation is a game of chess. Every move matters. Trying different strategies, anticipating the other side, switching tactics, this is what keeps it exciting. 3. No one will hand you money. You earn it. Registrations, drafting, research, writing headnotes. Do the work, create value, build your income. 4. Stay in your hometown, if you can. Your parents’ network is an underrated advantage. Familiarity, goodwill, and local connections matter more than we admit. 5. Don’t get lost in the field. Value family, friendships, physical health, and mental peace. Litigation is important, but it’s not your entire life. All the best! ❤️

To understand better read caption! ⚖️👇 The Core Concept: "Identification" When a client files a petition in court, they usually sign an affidavit (a written statement confirmed by oath or affirmation). For the court to trust this document, it must be notarized. However, a Notary often does not know the client personally. This is where you, the advocate, come in. You sign the document under a line that says "Identified by," followed by your name and Bar Council enrollment number. By doing this, you are officially vouching to the Notary and the Court that the person signing is exactly who they claim to be. Here comes the "Shortcut" Trap The video highlights a common but dangerous practice among junior advocates. Sometimes, due to a client being in a different city or in a rush, an advocate might "identify" the client without actually seeing them sign the paper. But if you identify a signature in the client’s absence, you are betting your license on that client’s honesty. What if the client and the advocate have a dispute over fees later? The client could turn around and claim, "I never signed that petition, the advocate forged it!" If evidence shows the client was elsewhere (e.g., in a hospital in another city) at the time of the supposed signing, the advocate faces charges of fraud, professional misconduct, and potentially perjury. As a first-generation Advocate, remember that your Enrollment Number is your professional reputation. Never sign an identification clause as a "favor." Ensure the client is physically present and provides valid ID before you vouch for them. In the legal world, a small procedural shortcut can lead to a permanent career end. I am sharing my anecdotes, tips and lessons over my years as a litigation lawyer. 1. Litigation has not bought me a car yet I am simply surviving and figuring life out one brief at a time. 2. Being employed as a litigation lawyer is not as glamorous as we imagined in law school. The reality is far more ordinary and demanding. 3. Litigation does not always pay the way we thought it would and sometimes, yes, I am broke. 4. I still get anxious appearing before certain courts. Confidence is something you grow into; it is not part of your practising certificate. 5.I do not know everything and I have learned that no lawyer ever truly does. 7. I have lost cases, and I have won some. Both teach lessons you cannot learn from textbooks. 8. Some of your friends will seem to make it faster, while your journey takes longer. Comparison only steals your peace. 9. Litigation is exhausting, and not every day feels meaningful or satisfying a truth many young advocates quietly live with. 10. Sometimes opposing counsel appears more truthful than your own clients. The profession teaches discernment very quickly. 11. Your client’s case is not your personal battle. Care deeply, but do not lose yourself in matters that are not yours to carry emotionally. 12. You will feel intimidated by judges and colleagues at times but with experience, fear slowly turns into familiarity. 13. You will build friendships with advocates you never expected to connect with. The courtroom has a strange way of creating community. 14. Some days feel repetitive you wake up, go to court, draft correspondence, meet deadlines, and simply exist. And somehow, that too becomes part of the journey. 15. You will eventually realise that litigation is not always what we imagined some people thrive in it, while others are simply learning how to survive and find their footing, and both experiences are valid. #lawyersofinstagram #litigation #lawcontent #litigationlawyer #litigationattorney
