Your employer has to mandatorily pay your full and final within 2 days... and if they don’t, you can complain against them under the Labour Laws... As per Section 17(2) of the Code on Wages 2019, which have come into effect from Nov 2025, your employer is required to pay your wages under full and final settlement within 2 days of your exit from the company... The two days are counted from: - Voluntary Resignation - Termination - Lay‑off - Closure of the business The wages include, all components of unpaid: - salary - incentives / allowances - overtime - leave encashment - variable pay This law applies mostly to all employees covered under the Code on Wages, regardless of their position, salary, category (bluecollar / white collar), or whether they are fixed‑term or permanent. If the employer does not settle within two days, the employee has to write the same to HR on record and mention the non-compliance. And thereafter, to show delay beyond reasonable cause, the employee can file a complaint with the Labour Commissioner or Labour Officer in the prescribed form as per the State of jurisdiction. Employers, on the other hand, should ensure that they have the capability to process employee liabilities in real time, and should move to HRMS software rather than relying on Excel sheets. #casarthakahuja
