NEW WAGE CODE The Modi govt is likely to implement 4 new labour codes soon. These will subsume 29 central labour regulations, aim to consolidate and simplify complex labour legislations. The centre had finalized the draft rules in Feb, 2021 and now around 23 states have pre-published draft rules on these laws.  WHEN WILL IT BE IMPLEMENTED: Media reports have quoted govt officials as saying that since labour is a state subject too, the centre wants states to implement these as well in one go.  Plus corporates are hoping for time to transition to these new codes.  . WHAT WILL CHANGE:  While the code brings about changes in leave, hours of work, we focus on how it will change the salary structure.  1. HIGHER RETIREMENT BENEFITS: The wage code requires the basic salary component to be at least 50% of the total CTC. Usually, this is at 30-40% because many components of the salary like PF contribution, Gratuity, HRA are dependent on this basic salary figure. If basic salary goes up, the employer has to contribute more to provident fund and gratuity. Further, those working for smaller periods on fixed term contracts will also be eligible for gratuity. Second, the labour codes read together lay down that gratuity must be calculated on ‘deemed’ basic salary which cannot be less than 50% of your total pay packet. 2. HIGHER TAXES: The allowances, apart from basic salary, bonus and some part of HRA, is non-taxable under the current rules. With the rise in the basic, taxes are also bound to go up. The non-taxable part will shrink significantly with the new changes. It will range from 20-25 per cent, from earlier 50 or more per cent. 3. LOWER TAKE HOME SALARY: As taxes increase and contribution to retirement benefits increase, the amount you get to take home reduces. So your salary can quietly shrink even when your CTC stays the same. 👀 From the November 21st labour code changes, at least 50% of your CTC now has to be treated as “wages” (basic salary + DA). That sounds technical, but it hits you in 3 ways: 1️⃣ Higher PF deduction – 12% gets applied on a bigger basic 2️⃣ Higher gratuity in the future – same CTC, fatter final cheque 3️⃣ Lower in-hand today – unless your company actually increases your CTC Short term = feels like a pay cut. Long term = your retirement pot and gratuity become bigger whether you like it or not. 📌 What you should do now: Check if your basic is now ~50% of CTC See if your PF deduction has gone up Ask HR how they’re implementing the new labour codes. #udayanonmoney

You can now work for only 4 days a week and your employer will have to give you 3 days of paid leave… As per the recent Labour Codes that have been brought into effect in India… Employees now have the flexibility to complete their 48 hours of weekly work requirements in 4 days of a week, and if they do, the employer must provide the remaining 3 days of the week as paid off… And if the employer makes you work more than 48 hours a week, then you are eligible to get double the salary for the extra hours worked under law as overtime… Of course, some people can choose to do 48 hours across 5 days or 6 days, but if you put in 12 hours a day for 4 days you are legally entitled to take the remaining days of the week off. This could be especially relevant in organisations like the Big Four audit firms, in marketing and advertising agencies, and in a number of other service based firms where employees in general work till late almost daily. The law also states that no person should be expected to work for over 12 hours in one day, and this 12 hour period includes sufficient time for rest, break and meals. All large enterprise (with 500 or more employees) have to comply with these rules immediately, and these rules will also apply to medium and small enterprise soon. This applies uniformly across all types of companies regardless of sector. Several states are working on implementing these rules within states as per more details. #casarthakahuja
