🚨 THE GOVERNMENT IS DILUTING THE RTI ACT🚨 With the Digital Personal Data Protection Act, the government also passed an amendment to the Right to Information act in 2023. This amendment provides a blanket exemption of “any information that pertains to personal information” as opposed to the application of the public interest test to justify denial of discourse due to “unwarranted invasion of privacy”. In this video, we urge you to sign the petition along with 31 prominent Civil Rights Groups, to stop the government from enforcing this law. They must be standalone documents. Clear. Itemized. Unmissable. The DPDPA does not impose direct obligations on processors and instead mandates the data fiduciary to ensure the data processor’s compliance. However, this is in stark contrast with the previous drafts of the Act. For example, Section 31 of the 2019 bill requires processors to implement appropriate technical and organisational measures to secure data. Section 25 imposed an obligation on data processors to notify the Data Protection Authority (DPA) about any breach. About a year from when Citizen Digital Foundation discussed this on a panel of government, legal, and industry representatives at #NASTech2022 Chennai, we have the much-awaited Digital Personal Data Protection Act (#DPDPA), that mandates platforms to seek informed, explicit user #consent before processing our data. It also mandates the necessary and proportional use of such data, limiting the purposes for which they are presently used without users’ knowledge. It’s even more important that citizens understand and question the use of their data by public and private entities. We are entitled to the services we sign up for using our personal, demographic and financial data. Voluntary consent for the processing of such data is not blanket consent for platforms and businesses to create manipulative dark patterns in their product design, or use our involuntary online behaviour data to coerce and alter our individual and collective behaviour and actions, way past acceptable limits, for-profit and political interests.
