At #DPAS2025, during the panel discussion “Beyond Economics: Exploring the Public Policy Implications of Cross-Border Data Flows in Africa,” Dr Martina Ferracane, Associate Professor of International Digital Trade at Teesside University and researcher at the European University Institute, shared compelling data on how data regulation choices affect intra-African trade. Drawing on empirical research, she explained that African countries adopting GDPR-style data protection frameworks tend to trade less with one another — particularly in services. The reason, she noted, lies in the high compliance costs such models impose on businesses, especially in lower-income economies. In contrast, her findings show that more open data flow regimes are associated with increased trade. By reducing restrictions on cross-border data flows within Africa, intra-regional trade could grow by up to 10%. In a powerful keynote, @Melissa Omino of the Centre for Intellectual Property and IT Law at reminded participants that before the dataset comes the human story, urging policymakers and technologists to centre people, rights, and lived experiences in the design of digital systems. Throughout the day, parallel sessions brought together researchers, technologists, policymakers, and community leaders to explore practical challenges and solutions across key areas including: •Data protection litigation and the evolving role of courts and regulators * Regulatory sandboxes for testing data governance models before scaling * Subnational data governance and collaboration with county governments * Community-led approaches to digital rights awareness * AI accountability and human oversight in critical systems We are deeply grateful to the many organizations, speakers, moderators, partners, and participants who contributed their expertise and perspectives to make this conference possible. At #DPAS2025, Teki Akuetteh, Executive Director of the Africa Digital Rights Hub, delivered a keynote titled “Behavioural Data, AI & Digital Sovereignty in Africa.” She challenged the audience with fundamental questions shaping Africa’s digital future: Who owns Africa’s behavioural data? Who governs it? Who benefits from it? And who ultimately controls Africa’s AI future? Her keynote examined how behavioural data now powers the digital economy, while AI systems increasingly infer sensitive traits such as political preferences, health risks, and emotions, often without consent or transparency. She warned that opaque algorithmic decision-making and advanced profiling pose serious risks of exclusion, manipulation, and weakened democratic processes.
