RTI Is Failing! They gave us the “right to ask”… Now they’re quietly making it impossible. The RTI Act was created in 2005 so that every citizen could question the government directly and demand transparency. And if a department didn’t respond properly, the Central Information Commission (CIC) and State Information Commissions (SICs) existed to hold them accountable. That system worked only as long as these bodies were fully staffed and active. But today, the very structure meant to protect transparency is slowly being hollowed out. At the central level, the post of the Chief Information Commissioner has been vacant multiple times since 2014 - including right now. Out of 10 Information Commissioner positions, only 2 are filled. Across states, the situation is just as bad. The result? Nearly 4 lakh RTI appeals are stuck in limbo. In 2019, the tenure of CICs and ICs was reduced from five years to three, giving the government even more control over appointments. And despite the rule that vacancies must be prepared for six months in advance, positions are left empty for long periods. Even the Supreme Court warned in 2023 that if this continues, the RTI will become a “dead letter”. Because when there is no one to enforce accountability, departments can get away with delaying replies, giving incomplete answers, or burying activists under thousands of pages of irrelevant documents. In many states, the backlog is so huge that at the current pace a single RTI appeal could take 7 to 29 years to resolve. RTI was meant to empower the common citizen. But without commissioners, without timely hearings, and without a functioning system, the law risks becoming just a formality on paper. If transparency matters to you, speak up and spread awareness. 🚨 THE GOVERNMENT IS DILUTING THE RTI ACT🚨 With the Digital Personal Data Protection Act, the government also passed an amendment to the Right to Information act in 2023. This amendment provides a blanket exemption of “any information that pertains to personal information” as opposed to the application of the public interest test to justify denial of discourse due to “unwarranted invasion of privacy”.
