📢 OPT Students — Important Info on Unpaid Work! ✅ USCIS allows unpaid or volunteer work during the initial 12-month OPT, but there are important rules you (and your employer) must follow: 🔹 The work must be directly related to your major field of study. 🔹 The position must comply with labor laws, especially the Fair Labor Standards Act (FLSA). 🔹 It must be a bona fide volunteer role — typically at nonprofits, schools, or public sector organizations. 🔹 For for-profit employers, unpaid work must pass the 7-factor FLSA test: See https://www.dol.gov/agencies/whd/fact-sheets/71-flsa-internships for DOL FLSA rules for unpaid positions Training must be like an academic setting. No expectation of pay. You’re not replacing a regular employee. Big mahalo to @wsrsl_flsa (Filipino Law Students Association) & @tides_uhm (Filipino & Pacific Islander Student Equity, Excellence, and Diversity) for inviting me to be a judge for their UH Student Orgs Adobo Cook-Off! Not only was the food onolicious, but the vibes were too! From games and a photobooth to karaoke that had everyone singing their hearts out — this was community at its best. It was such a joy to witness our next generation of leaders coming together in the spirit of culture, connection, and (friendly) competition. FLSA requires that each employee receives a classification upon hiring. And while it may seem like a simple step, the classification options can be confusing. One of the most common mistakes is classifying employees as independent contractors when they’re not. The IRS states that if “an employer-employee relationship exists (regardless of what the relationship is called)” then the employee is not an independent contractor. Whether or not such a relationship is considered “employer-employee” depends upon the culmination of a number of factors as well as the individual circumstances of the situation. Such factors may include: ✅ the right to terminate the individual ✅ the mode of payments ✅ the supplying of tools and/or equipment ✅ the belief of the parties as to the existence of an employer-employee relationship ✅ the length of employment Many restaurant owners hire independent contractors, and they shouldn’t be. When this is done wrong, as I have seen time and time again, it can cause lots of financial, legal, and cultural trouble. We don’t want to leave our baby and we can’t stop thinking about when we will be able to squeeze in that pumping break in our day. • The Fair Labor Standards Act (FLSA) Protections to pump at work makes it LEGALLY necessary for employers to offer private, uninterrupted breaks for employees to pump during the work day up until the baby’s first birthday. • Don’t forget your pump AND charger. Nothing would bring more stress than if you thought you had your pump fully charged and it was actually low battery. • Always bring more milk storage than you think you’ll need. Whether it’s bottles, bags, or the @cereschill ! This one can fit up to 24 oz of breastmilk (more than enough for my 8 hour work day!)
