FLIn simple terms, “Right-of-Way” means who is LEGALLY allowed to maintain their course. These rules help pilots maintain safe separation by providing predictability. Just like with collision avoidance, these rules apply in flight, on the ground, or anytime you’re operating an aircraft. 14 CFR 91.113 says who has the right-of-way and the procedures for adjusting course.
This post addresses your course of action if two aircraft of the SAME CATEGORY are converging, approaching head-on, overtaking, and landing simultaneously. Speaking of landing simultaneously, do NOT try to use this rule to cut off another aircraft. § 91.113 explicitly says, “When two or more aircraft are approaching an airport for the purpose of landing, the aircraft at the lower altitude has the right-of-way, but it shall not take advantage of this rule to cut in front of another which is on final approach to land or to overtake that aircraft.” Lastly, remember that an aircraft in distress has the right-of-way over ALL other air traffic.
