LAIs Moonlighting Illegal in India?
Moonlighting is the practice of working additional hours outside of one's principal job, usually in the evenings or on weekends. In the IT industry, this frequently entails full-time personnel freelancing on the side.
Many people in India opt to moonlight due to financial constraints such as inflation and low wages. Others use it to advance their careers or to supplement their income in the face of increasing layoffs and job uncertainty.
However, employers typically reject it. They are concerned about decreased productivity, diverted attention, and breaches of confidentiality, particularly in sensitive sectors such as technology.
Moonlighting is legally ambiguous. There is no blanket ban, but job contracts and labour rules play an important role. Most contracts include exclusivity restrictions, which prohibit side jobs without the employer's agreement. Violating these can result in termination or legal action.
Big IT companies like Wipro and Infosys have fired employees for moonlighting, citing contract violations.
According to Indian laws, the Factories Act of 1948 prohibits industrial workers from engaging in second jobs. Similar limits apply under state laws, such as the Delhi Shops and Establishments Act of 1954.
At the same time, Section 27 of the Indian Contract Act of 1872 disqualifies excessively broad terms that unfairly exclude authorised professions. Courts have affirmed this in cases such as Gujarat Bottling Co. vs. Coca-Cola (1995), holding that employer limits must be reasonable.
For example, prohibiting a software engineer from performing unrelated freelance graphic design could be considered excessive unless it directly competes with the employer’s business.
