When I say I’ve seen some unbelievable things in workers’ compensation claims, this is exactly what I mean. Imagine filing a claim against a former employer and listing your name as “Rocio Luna aka Lucy Mendez.” Really?????!!!! At what point does something like this get questioned? What applicant attorney accepts an application like this without validating the most basic information?! From an employer’s perspective, this should be an automatic red flag if not outright denial, for failing to provide accurate and verifiable details. But that’s NOT how the system works. Instead, employers are still required to move forward investigate, gather documentation, and defend their side regardless of how questionable the claim may appear on its face. And yes, this is a post-termination cumulative trauma claim. Situations like this raise a bigger question: When will California legislation evolve to address these gaps? At what point do we create a system that protects legitimate claims while also preventing clear misuse? ##workerscomp #California #weneedchange
