LAPOCSO Court Process (As per BNSS & POCSO Act)
1. FIR Registration (Section 173 BNSS)
FIR must be registered immediately.
If the victim is a girl, the statement should be recorded by a female police officer.
Free legal aid and support must be provided to the victim.
2. Medical Examination (Section 184 BNSS)
The medical examination must be conducted within 24 hours.
Preferably carried out by a female doctor.
A parent or guardian must be present during the examination.
3. Statement Before Magistrate (Section 183 BNSS)
The victim’s statement is recorded before a Magistrate.
The police must complete the investigation within 90 days.
The charge sheet is then forwarded to the Special POCSO Court.
4. Investigation & Charge Sheet (Sections 28 & 33, POCSO Act)
Proceedings are conducted in-camera to ensure privacy.
Investigation should be completed within 90 days.
Use of screens and video conferencing is permitted.
5. Child-Friendly Procedure (Section 36, POCSO Act)
No aggressive or intimidating questioning of the child.
Assistance of a Child Welfare Officer must be provided.
6. Appeal (Section 420 BNSS)
The right to appeal is available as per law.

यह धारा भरण-पोषण (Maintenance) से संबंधित है। इसका उद्देश्य उन लोगों को आर्थिक सहायता दिलाना है जो स्वयं अपना भरण-पोषण नहीं कर सकते।
📌 धारा 125 CrPC/144 BNSS क्या कहती है?
यदि कोई व्यक्ति अपनी पत्नी, बच्चों या माता-पिता का भरण-पोषण करने में लापरवाही करता है या इंकार करता है, तो मजिस्ट्रेट उसे मासिक भरण-पोषण राशि देने का आदेश दे सकता है।
👥 कौन-कौन भरण-पोषण मांग सकता है?
1️⃣पत्नी
▪️वैध पत्नी
▪️तलाकशुदा पत्नी (जब तक उसने पुनर्विवाह न किया हो)
2️⃣बच्चे
▪️नाबालिग पुत्र/पुत्री
▪️वयस्क संतान (यदि शारीरिक या मानसिक रूप से असमर्थ हो)
3️⃣माता-पिता
पिता और माता, यदि वे स्वयं अपना भरण-पोषण नहीं कर सकते
⚖️ शर्तें (Essential Conditions)
▪️सामने वाला व्यक्ति पर्याप्त साधन (Income/Means) रखता हो
▪️इसके बावजूद वह भरण-पोषण देने से इंकार या लापरवाही कर रहा हो
▪️मांग करने वाला व्यक्ति खुद का गुजारा करने में असमर्थ हो
💰 भरण-पोषण की राशि
▪️कोई फिक्स लिमिट नहीं
▪️कोर्ट तय करती है, इन बातों को देखकर:
▪️पति/व्यक्ति की आय
▪️जीवन-स्तर (Standard of living)
▪️आश्रितों की जरूरत
🏛️ केस कहां फाइल होता है?
▪️जहां पत्नी/आश्रित रहते हों, या
▪️जहां प्रतिवादी (जिससे भरण-पोषण मांगा जा रहा है) रहता हो
❌ भरण-पोषण न देने पर क्या होगा?
▪️मजिस्ट्रेट वारंट जारी कर सकता है
▪️अधिकतम 1 महीने की सिविल जेल (प्रत्येक चूक के लिए)
📚 धारा 125 CrPC/144 BNSS की खास बात
▪️यह सिविल अधिकार होते हुए भी आपराधिक प्रक्रिया के तहत आती है
▪️इसका उद्देश्य तुरंत राहत देना है, न कि लंबी मुकदमेबाजी
📍मोहम्मद अहमद खान बनाम शाह बानो बेगम (1985)
सुप्रीम कोर्ट ने फैसला दिया कि तलाकशुदा मुस्लिम महिला भी धारा 125 CrPC के तहत भरण-पोषण की हकदार है, सिर्फ़ इद्दत अवधि तक ही नहीं।
➡️ कोर्ट ने कहा:
धारा 125/ 144 BNSS सभी धर्मों पर समान रूप से लागू होती है।
📌 महत्व:
महिलाओं के अधिकार मजबूत हुए बाद में इस फैसले के बाद मुस्लिम महिला (तलाक पर अधिकार संरक्षण) अधिनियम, 1986 बना यह फैसला भरण-पोषण कानून में मील का पत्थर माना जाता है।

SH🚨 REFUSAL TO FIR CAN LEAD TO ACTION AGAINST OFFICERS?
Yes — You can take LEGAL ACTION against them.
Here are ALL constitutional & legal remedies
⚖️ LAW 1 — FIR REGISTRATION IS MANDATORY
Under Section 173 BNSS, police must register FIR if a cognizable offence is disclosed.
Police cannot refuse FIR arbitrarily.
Refusal is illegal.
Preliminary inquiry allowed only in limited category cases.
If cognizable offence appears → FIR MUST be registered.
⚖️ LAW 2 — IF SHO REFUSES → COMPLAINT TO SP
Section 173(4) BNSS gives right to approach Superintendent of Police.
SP can:
• Order FIR registration
• Investigate himself
• Transfer investigation
• Take disciplinary action against SHO
• Initiate departmental inquiry
⚖️ LAW 3 — IF SP ALSO REFUSES → GO TO MAGISTRATE
Section 175(3) BNSS (strongest remedy)
You can file application before Judicial Magistrate.
Court can:
• Order FIR registration
• Direct investigation
• Monitor police investigation
• Take action against police officers
• Call explanation from SHO/SP
⚖️ LAW 4 — DIRECT COMPLAINT BEFORE MAGISTRATE
You can bypass police completely.
File private complaint before Magistrate.
Court can:
• Record complainant statement
• Examine witnesses
• Order police inquiry
• Issue summons to accused
• Start criminal case directly
⚖️ LAW 5 — ACTION AGAINST POLICE OFFICER (MOST IMPORTANT)
If police deliberately refuse FIR, you can seek action against them:
• Departmental inquiry
• Suspension of officer
• Disciplinary proceedings
• Adverse service entry
• Transfer from post
• Contempt of court proceedings
• Criminal prosecution
• Compensation claim
⚖️ LAW 6 — CRIMINAL ACTION AGAINST POLICE (BNS SECTIONS)
Police officers refusing FIR may be prosecuted under:
Section 198 BNS — Public servant disobeying law causing injury
Section 199 BNS — Public servant framing incorrect record
Section 200 BNS — Public servant intentionally omitting duty
These sections allow criminal action against SHO / SP.
They can face prosecution for refusing FIR.

The Delhi High Court directed the immediate defreezing of the bank accounts of Malabar Gold and Diamond Limited.
