But many projects face delays simply because society members are unaware of the key legal guidelines involved. Here are some essential redevelopment rules every society should know 👇🏻 • Eligibility First: As per DCPR 2034, the building should generally be 30+ years old or officially declared dilapidated after a structural audit. • Essential Documents: Societies must have Conveyance Deed, Property Card, and approved building plans to legally start redevelopment. • Member Consent: A Special General Body Meeting (SGM) is required, and minimum 51% member approval is needed to move forward. • Feasibility Report: A PMC or architect must evaluate the project and prepare a technical feasibility report. • Agreement Registration: Key agreements like the Development Agreement and PAAA must be registered under the Registration Act, 1908. • Stamp Duty Clarity: Development Agreement stamp duty is usually borne by the developer, while PAAA requires nominal charges (₹100 stamp duty + ₹1,000 registration). • Transparency Matters: Developer tenders must be openly discussed with all society members. • Avoid Informal Voting: Redevelopment decisions should not rely on WhatsApp polls — official notices and recorded meetings are essential.
