Article 19(1)(f): Right to Property - Removed by the 44th Constitutional Amendment Act, 1978 Earlier, Indian citizens had a Fundamental Right to acquire, hold, and dispose of property under Article 19(1)(f), along with Article 31. However, during land reforms (like abolition of zamindari), this right was frequently challenged in courts by large landowners. To allow the government to implement social and land reforms, this right was removed by the 44th Constitutional Amendment Act, 1978 during the Morarji Desai government. Now, the Right to Property is no longer a Fundamental Right. It exists only as a legal/constitutional right under Article 300A of the Constitution of India. Articles 20 and 21 of the Indian Constitution are considered non-suspendable, even during a National Emergency. During a National Emergency under Article 352, Article 359 allows the President to suspend the enforcement of some Fundamental Rights. However, after the 44th Constitutional Amendment Act, 1978, Articles 20 and 21 were kept outside this power. This means their enforcement can never be suspended, even during an emergency. Article 20 provides essential legal protection to an accused person. Article 21 guarantees the right to life and personal liberty to every individual. Suspending these rights would give the State unlimited and arbitrary power. Therefore, the Constitution protects Articles 20 and 21 in all circumstances.
