These are things like real estate or private investments/companies If you’re an credited investor ($200k annual income $1mm net worth) you can gain access to more. Relying on a Revocable Living Trust to eliminate Capitol gains tax on inherited real estate property is a mistake. Note that there are other types of trusts that can help avoid gains like an Upstream Basis Trust, or a Charitable Remainder Trust but if you’re taking the path of avoiding more complex planning (or if it’s too late to take those steps) there are 5 ways to avoid paying Capitol gains on inherited property: 1. Make the Inherited Property Your Primary Residence -The IRS allows single taxpayers that make an inherited property their primary residence for at least two years of the five years preceding the sale of the property to exclude up to $250,000 of the capital gains from the sale. 2. Sell the Inherited Property Immediately -relying on the step-up in basis loophole. 3. Rent Out the Inherited Property -use a 1031 tax exchange to defer taxes. This can allow you to keep the property and turn it into a money-generating venture. 4. Disclaim the Inherited Property -If you don’t want to deal with selling an inherited property or incurring capital gains taxes on its sale, you can choose to disclaim your inheritance or a portion of it. If you do this, there is no going back 5. Deduct Closing Costs from the Capital Gains - Need help with planning?
