The GDPR (General Data Protection Regulation) is a comprehensive data protection law that came into effect on 25 May 2018 across the European Union (EU) and the European Economic Area (EEA). It regulates how organizations handle personal data of individuals in the EU/EEA, regardless of where the organization itself is located. Here are the key points: 1. Scope Applies to any company (inside or outside the EU) that processes the personal data of EU/EEA residents. Covers both controllers (decide how and why data is processed) and processors (process data on behalf of controllers). 2. Core Principles Organizations must process personal data lawfully, fairly, and transparently, following these principles: Lawfulness, fairness, transparency – Data subjects must know what happens with their data. Purpose limitation – Data can only be collected for specific, explicit purposes. Data minimization – Only the necessary amount of data should be collected. Accuracy – Data must be kept accurate and up to date. Storage limitation – Data should not be kept longer than necessary. Integrity and confidentiality – Data must be secured. Accountability – Organizations must be able to demonstrate compliance. 3. Rights of Individuals Under GDPR, people have strong rights over their data, including: Right of access (know what data is held about them). Right to rectification (correct inaccurate data). Right to erasure (“right to be forgotten”). Right to restrict processing. Right to data portability (move their data to another service). Right to object (to processing or profiling). Rights related to automated decision-making and profiling. 4. Legal Bases for Processing Organizations must have a valid legal basis to process data, such as: Consent Contractual necessity Legal obligation Vital interests Public task Legitimate interests (balanced against the rights of individuals) 5. Accountability & Obligations Organizations must keep records of data processing activities. May need to appoint a Data Protection Officer (DPO).
