Today’s announcement will help cut off the funds that fuel organized crime and help keep Canadians safe. 🇨🇦 — Aujourd’hui, j’ai envoyé un message simple et fort : c’est assez. Expanded Scope: The legislation targets “electronic service providers,” which can include any service that stores or transmits data. It also allows for the compulsion of foreign entities providing services in Canada, extending Canadian jurisdiction for data requests. Under Section 8 of the Canadian Charter of Rights and Freedoms, you are protected against unreasonable searches and seizures. This protection applies to your personal belongings, including your cell phone. Today, a phone contains an enormous amount of private information: emails, locations, conversations, photos, and many aspects of your personal life, often unrelated to the reason for the police stop. Police officers cannot force you to provide your password or your biometric data, such as your fingerprint or facial recognition, unless they have a specific search warrant. And a valid warrant must clearly authorize not only the search of the phone, but often the specific data they are allowed to examine. If you voluntarily hand over your phone or provide your password, you may be giving up this protection. Once consent is given, anything discovered can potentially be used as evidence. Your privacy rights are important, and understanding them can make a significant difference in a criminal case.
