RIPolice often ask for your phone PIN in custody and suggest that refusing could lead to prison.
But that’s not the full picture.
Under UK law, it only becomes a criminal offence if a properly authorised Section 49 RIPA notice has been formally served requiring you to disclose the PIN or decrypt data.
Only if you refuse after that notice can you potentially commit an offence under Section 53 RIPA.
In reality, officers sometimes read out what sounds like a legal notice during interview — when it’s actually just an advisory warning. If you don’t have a solicitor, you’d probably think that’s the real thing.
That’s where people get pressured into giving access to their phone.
Always take legal advice before making any decision.
Once you give your PIN… you can’t take it back.
