Code on Social Security, 2020 મુજબ fixed-term employees ને gratuity માટે 5 વર્ષ પૂરા કરવાના નથી — proportionate gratuity એક વર્ષથી ઓછી service પર પણ મળવી શકે છે (contract terms મુજબ). આ rule ત્યારે લાગુ પડે જ્યારે labour codes officially notify અને implement થાય. ઘણા લોકો આ હક જાણતા જ નથી. Could India really move to a 4-day work week? Yes, legally, it’s now possible. Under India’s new Labour Codes, the total working hours remain capped at 48 hours per week. What has changed is the flexibility in how these hours can be structured. Earlier, most organisations spread these hours over 5 or 6 days. Now, the law allows companies to distribute the same 48 hours across just 4 days which effectively means 3 paid days off in a week, if both employer and employee agree. A few important clarifications: • A 12-hour workday includes breaks, intervals and lunch • Any work beyond 48 hours in a week qualifies as overtime • Overtime must be paid at double the normal wage rate • This framework applies across sectors; manufacturing, services, corporate roles, etc. That said, this is not mandatory yet. The Labour Codes have been notified, but since labour is a concurrent subject, states will roll out detailed rules at their own pace. So no, India has not officially shifted to a 4-day work week. But yes, the legal framework now allows it. And honestly, just knowing that the law itself recognises the need for better work-life balance feels like a step in the right direction. Would be interesting to see how progressive organisations choose to adopt this over time.

Here are the major proposed / phased changes in short: • 4 Labour Codes instead of 29 laws (Wages, Industrial Relations, Social Security, Occupational Safety) • Basic salary = minimum 50% of CTC 👉 Higher PF & gratuity, slightly lower take-home • 4-day work week option 👉 Same weekly hours, flexible working days (optional, not mandatory) • Gratuity after 1 year 👉 Earlier 5 years required • PF, ESIC for gig & platform workers 👉 Ola, Uber, Swiggy workers included • Overtime limit increased 👉 More legal overtime flexibility • Earned leave after 180 days 👉 Earlier 240 days • Salary payment deadline 👉 Salary to be paid before 7th of next month • Full & Final settlement timeline 👉 Within 2 working days of exit • Fixed-term employment allowed 👉 Same benefits as permanent employees, no retrenchment pay • Women allowed night shifts 👉 With safety & consent norms ⚠️ Important: Most changes are not fully implemented nationwide yet.
