B.: • du an eine Kapitalgesellschaft (z. B. GmbH/UG) bezahlst (kein Automatismus, Einzelfall beachten) • es sich um reine technische Leistungen ohne kreativen Anteil handelt • oder keine selbstständige künstlerische/publizistische Leistung vorliegt 👉 Graubereich (häufig Streitpunkt): • Social Media Manager • Online-Marketing / Performance Marketing • Content-Produktion mit technischem Fokus Hier kommt es stark auf die konkrete Tätigkeit im Einzelfall an. Das Problem: Wenn du solche Leistungen einkaufst, kannst du Künstlersozialabgabe zahlen müssen (ca. 5 % der Honorare). Und viele wissen das nicht. — Wann es kritisch wird: • du arbeitest regelmäßig mit Freelancern in diesen Bereichen • du führst keine KSK-Abgabe ab • und es kommt zu einer Prüfung (oft durch die Rentenversicherung) 👉 Folge: Nachzahlungen von bis zu 5 Jahren rückwirkend + Zuschläge Die Rechtsform schützt dich nicht automatisch.
