That’s because the moment they go to claim the property and get it registered in their name... they are asked for a document - the “Succession Certificate”
And to get this is one of the hardest things on the planet if their parents did not leave a Registered Will mentioning them as the legal heir.
The Succession Certificate is a document issued by the district courts... It grants authority to manage the deceased’s bank accounts, investments, and financial assets.
The process requires filing a petition in the court where the deceased resided or where assets are located, followed by a mandatory 45-day public notice period allowing for objections.
And till the time these documents are not obtained, banks freeze the accounts, not letting anyone use the account, draw money, or make payments from them... Same with Demat accounts and shares held in parents name.
So the NRI has to get all their foreign documents apostilled in the foreign country, and make a Power of Attorney to appear in court, file several affidavits and indemnities.
And this entire process of obtaining this certificate takes anywhere between 6 to 18 months...
The stamp duty could be anywhere between 2-3% of the asset value... and some lawyers charge a % of the asset value, as high as 5%...
In Delhi, the Court Fee itself is 4% of the Estate Value.
For a professional to charge a % of such value may actually not be permitted under some regulations, but it is a market reality.
And this entire process can cost no less than Rs 10-20 lakhs and a couple of years.
To avoid all of this and to ease the process, I would recommend each NRI to do two things -
First, please update your names under nomination at every bank, insurance policy, mutual fund, and demat account. It may sound boring, but should be a priority.
And second, get your parents to make a Registered Will specifying the assets, the beneficiaries, and the identifying details therein.
