What does Article 38 of the Indian Constitution say? ⚖️ Did you know the Constitution directs the State to create a welfare state and reduce inequality in society? Article 38 of the Constitution of India is part of the Directive Principles of State Policy (DPSP). It directs the State to promote the welfare of the people by establishing a social order based on justice. This justice includes social, economic, and political justice, ensuring that every citizen gets equal opportunities and dignity in society. The Article also requires the State to reduce inequalities in income, status, facilities, and opportunities among individuals and groups. This provision reflects the Constitution’s vision of building a welfare state where fairness and equality are central values. ⚖️ What Article 38 Says Article 38(1) The State shall promote the welfare of the people by securing a social order in which justice — social, economic, and political — informs all institutions of national life. However, during land reforms (like abolition of zamindari), this right was frequently challenged in courts by large landowners. To allow the government to implement social and land reforms, this right was removed by the 44th Constitutional Amendment Act, 1978 during the Morarji Desai government. Now, the Right to Property is no longer a Fundamental Right. It exists only as a legal/constitutional right under Article 300A of the Constitution of India.
