India’s parliament passed a bill that changes how the government recognizes trans people, sparking outrage. Now, trans people can’t self-identify their gender, a right they won in a 2014 landmark Supreme Court case. The government will only recognize gender based on a person’s biological or physical traits, which critics say excludes those who are non-binary, gender-fluid, intersex, or from the hijra community. The Transgender Persons Bill, an amendment to the 2019 Transgender Persons Act, also requires those seeking gender-affirming surgery to get permission from medical boards and district authorities. “It has shattered our identity,” trans rights activist Laxmi Narayan Tripathi told BBC. Members of the LGBTQ+ community have been protesting the bill for weeks. India is home to at least 2 million trans people, with some estimating the number to be far higher. Many from the community face disproportionate discrimination, violence, and assault, and are often forced to pursue informal work. Actor and Member of Parliament Jaya Bhaduri condemned the bill at a Rajya Sabha meeting. “We need representation of that community in these two Houses,” she said. “Listen to their struggles, listen to their pain, and then bring this bill to the House.” Bhaduri also criticized the House’s haste in voting on the bill. “What is the urgency in bringing this bill at this stage? Why can it not be examined with the depth it deserves?” The BJP government argues that the current definition of a trans person is too vague and that by narrowing the definition, it can ensure benefits, such as jobs and healthcare, reach people with the highest need. Critics remain unconvinced. A Supreme Court-appointed advisory panel has asked the government to rescind the bill, saying that it contradicts its 2014 ruling.
